Chapter 13

Chapter 13 is another Bankruptcy Option. A Chapter 13 case offers debtors many ways to reorganize their finances, including:

    cure arrearages on home and car loans;
    lower interest rates on some debts;
    stop interest and penalties on unsecured debt;
    stop creditors from foreclosing on your home, repossessing your car, or garnishing your wages;
    stop creditors from harassing you.

In Chapter 13, you propose a plan that shows how you intend to repay all or a portion of your debt. Your case will last 36 to 60 months. After your case is filed, you will start making payments to the Chapter 13 Trustee each month. Once the Court approves your plan, the Trustee will use the money to pay your creditors as outlined in your plan. This website discusses Chapter 13 in more detail.
